The Milon K. Banerji Arbitration Centre was pleased to collaborate on a two-day round table examining India’s insolvency arbitration framework. The event brought together judges, senior advocates, insolvency professionals, and academics to address what happens when arbitration and insolvency proceedings collide.

Discussion over the two days covered the arbitrability of insolvency-related disputes, jurisdictional tensions between the NCLT and arbitral tribunals, the enforceability of arbitral awards during insolvency, and the practitioner experience of navigating these questions on the ground. The second day extended the conversation to comparative and cross-border dimensions, including the proposed IBC Amendment Bill, 2025, and lessons from the UK, US, Singapore, and the EU.

Speakers on the first day included Dr. N. V. Badrinath, former Judicial Member of the NCLT; Ms. Pooja Saigal, Senior Advocate; Ms. Shreya Parikh, Associate Director of the Milon K. Banerji Arbitration Centre and Counsel at the Bombay High Court; Mr. M. Gopal, Associate Partner at Lakshmikumaran and Sridharan; Ms. Prachi Johri, Advocate on Record before the Supreme Court of India; and Mr. A. V. Subbarayudu, Founding Partner of Finnlex Law LLP.

The Milon K. Banerji Arbitration Centre remains committed to fostering this conversation and to contributing to the development of a framework that reflects India’s growing place in international commerce.
